Terms of Service for TargetWise

1. Acceptance of Terms

By accessing or using TargetWise (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

TargetWise provides a performance platform for tracking clay target shooting scores, managing equipment and loadouts, capturing coaching notes, and receiving AI-driven performance insights. The Service includes both free and premium features.

3. User Accounts & Age Eligibility

  • You must be at least 18 years of age to register an independent account on TargetWise.
  • Users under 18 years of age may only access or be managed on the Service through an account authorized by a parent, legal guardian, or an accredited coach who has obtained explicit parental consent.
  • You are responsible for safeguarding your account password and for all activities under your account.
  • You agree to provide accurate, current, and complete information during registration.

4. User-Generated Content

  • You retain all ownership rights to the score data, notes, inventory details, and photos you upload to the Service (“User Content”).
  • You grant TargetWise a limited, non-exclusive, royalty-free, worldwide license to store, display, and process your User Content solely for operating and providing the Service to you and your authorized coaches.
  • You are solely responsible for your User Content and assume all risks associated with its accuracy.

5. Subscriptions and Payments

  • Certain premium features are available through a paid subscription (“Pro Plan”).
  • Subscription fees, billing cycles, and included features are disclosed at the time of purchase.
  • All payments are processed securely via Stripe. TargetWise does not store full credit card details.
  • Subscriptions automatically renew unless cancelled prior to the end of the current billing cycle through your Account Settings.

6. Prohibited Conduct

You agree not to:

  • Violate any applicable local, national, or international laws or regulations.
  • Upload unlawful, harmful, defamatory, or deceptive content.
  • Attempt to gain unauthorized access to other user accounts, coach portals, or computer systems.
  • Interfere with or disrupt the performance or integrity of the Service.

7. Termination

We reserve the right to suspend or terminate access to the Service immediately, without prior notice, for conduct that violates these Terms or harms other users.

8. Disclaimers and Limitation of Liability

  • Service Availability: The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
  • AI-Generated Content: AI-powered feedback, summaries, and note enhancements are for informational and instructional assistance only and do not replace certified coaching or personal safety judgement. TargetWise is not liable for outcomes resulting from reliance on AI-generated analysis.
  • Firearm Safety: You are solely responsible for the safe and legal handling of all firearms, ammunition, and gear. TargetWise is a data-tracking software tool and assumes no liability for physical activity or firearm handling. Always adhere to official firearm safety rules and local regulations.
  • Liability Cap: To the fullest extent permitted by law, TargetWise’s aggregate liability for all claims shall not exceed the greater of one hundred New Zealand dollars (NZD $100) or the total amount paid by you to TargetWise in the preceding 12 months.

9. Dispute Resolution & Governing Law

  • You agree to first attempt to resolve any dispute informally by contacting us.
  • These Terms are governed by and construed in accordance with the laws of New Zealand. Any unresolved disputes shall be submitted to arbitration in New Zealand under the Arbitration Act 1996.
